Man deceased a year ago receives court date due to MIRA payable not being followed through

Criminal Court scheduled a court date for an individual who has been deceased a year ago, whereby the trial was to be conducted online today at 9:00am. The issue came to the attention of the Criminal Court when MIRA didn't receive payable by the accused.

The Criminal Court has scheduled a court date for an individual who has been deceased a year ago (in August 2024), whereby the trial was to be conducted today morning at 9:00 via online means. The issue came to the attention of the Criminal Court when MIRA didn't receive the required payables in connection with the judgment the accused received.

The trial concerns the request of sentencing 31-year-old Th. Thimarafushi resident Muawiyath Moosa. The Criminal Court has stated that the sentencing will revolve around the crime of theft and will be enforced as such. As told to Mihaaru by the Prosecutor General's Office, he had received a prior sentencing on 12th April 2022. A punishment of MVR 42,000 was to be paid to MIRA within six months, along with 783 hours of community service.

The issue of the MVR 42,000 not being paid was taken to the PG office by MIRA on 17th June 2025, long after Muawiyath's death.

"The issue was filed to this office on 17th June 2025 by MIRA, stating that the money had not been received by them. This office has moved for a review of the sentence under the written procedural rules," stated the PG office.

The body of Muawiyath, an individual who has a record of being linked to substances/drugs, was found dead at a hotel in Thailand, Bangkok.

The Criminal Court said that they had not been made aware of the fact of Muawiyath's death and that the issue was brought to the attention of the PG office this year. It is reasonable to assume that Muawiyath was no longer in this world when the issue was presented to the PG office. The case number shows that it was presented this year as well.

The Criminal Court stated that after receiving the information that Muawiyath had passed, they had gotten in contact with the Department of National Registration (DNR) to confirm its legitimacy.

As per Criminal Procedure Code procedure, if an individual who is being charged has passed, the charges will be dropped.

With reference to the comments made by Muawiyath's family to the media, reports say that he left for Thailand after getting a new passport made for him, even though the family went through the effort of taking his old passport from him to stop him from travelling.

The family is making the accusation that since he was an individual who was unemployed and had no savings, he may have traveled with some group of individuals and then subsequently gotten murdered.

Thailand authorities have buried Muawiyath after conducting an autopsy, with the autopsy report and its information having not been shared or released to any party.
