The Civil Court has ordered a large sum for compensation and to hand over the K-Park apartment that was bought by an individual by the end of the month regarding the case in the sale of the same apartment units to multiple buyers and misappropriating the proceeds for personal use.
Hanbo Company, the developer of the project, was charged in the case by an individual who had bought an apartment from K-Park Residence, Hulhumale', in 2019 for MVR 4.1 million. However, he has not received the apartment nor the money he used to purchase the apartment to this day.
And so, he took the case to the Civil Court and pressed charges in order to procure the apartment and if that were not possible, for him to be compensated MVR 25,000 for each month the apartment had not been handed over to him.
Hanbo Company has not given any response at trial.
The sentence that was handed down from the Civil Court yesterday reads that Hanbo Company has been ordered to give the apartment to the individual who had bought the apartment by the end of the month. The sentence also requires the company to pay the individual MVR 1.9 million in damages by April.
Along with that, the Civil Court stated that Hanbo Company is to pay the individual MVR 25,000 for each month until the apartment is handed over as compensation.
The Civil Court has put out other sentences in the past where Hanbo Company had been ordered to hand over the K-Park apartments.
Mamdhooh, a shareholder of Hanbo Company, the developer of the project, was charged with multiple offences, including selling the same apartment units to multiple buyers and misappropriating the proceeds for personal use. The charges included 46 counts of fraud, 44 counts of obtaining illicit benefit through misrepresentation, three counts of issuing invalid documents, and one count of money laundering.
Criminal Court found Mamdhooh guilty on the majority of the charges and handed down sentences amounting to a combined total of 390 years’ imprisonment.
Mamdhooh’s co-accused, Jaishan Saeed of Raa Atoll Alifushi, was sentenced to more than 150 years in prison after being convicted on 86 of the 95 charges brought against him. Jaishan received 159 years. These sentences are the longest prison sentences that have been handed down in the history of Maldives.
